By purchasing a ticket to, or attending, the Delray Tribute Festival (the "Festival"), you agree to the terms below. In these terms, "Festival" means the Delray Tribute Festival and its organizers, producers, affiliates, partners, sponsors, vendors, and the event venue.
All artists, tribute acts, performances, set times, and schedules are subject to change or cancellation without notice. The substitution, rescheduling, or cancellation of any individual performer or act does not constitute a material change to the event and is not grounds for a refund.
All ticket sales are final. Tickets are non-refundable and non-transferable except as expressly stated at the point of purchase. Once gates open on a given day, that day is deemed fully delivered.
The Festival takes place rain or shine. Inclement weather and performance delays are outside the Festival's control and are not, by themselves, grounds for a refund or partial refund.
The Festival is not liable for any failure or delay caused by events beyond its reasonable control, including weather, fire, flood, storms, government action, public-health orders, acts of terrorism, strikes, power failures, or other acts of God. If the entire event is cancelled for such reasons, any remedy will be limited to what is stated at the point of purchase.
You voluntarily assume all risks of personal injury, illness, or property loss or damage arising from or relating to attendance at the Festival, whether caused by negligence or otherwise, including risks associated with crowds, weather, sound levels, and the venue.
To the fullest extent permitted by law, you release and discharge the Festival from any and all claims, liabilities, or damages arising from your attendance. The Festival is not responsible for personal property that is lost, stolen, damaged, or left behind.
You agree to defend, indemnify, and hold the Festival harmless from any claims, demands, damages, losses, or expenses (including attorneys' fees) arising from your own acts, omissions, or violation of these terms.
By entering, you consent to being photographed, filmed, and recorded, and you grant the Festival the irrevocable right to use your name, image, likeness, and voice in any medium, worldwide, for promotional, archival, or commercial purposes, without further notice, consent, or compensation.
A ticket is a revocable license to attend. The Festival may revoke it and deny or revoke entry, without refund, for cause.
The Festival reserves the right to refuse admission to, or remove, any person whose conduct is disorderly, unsafe, or in violation of Festival rules, venue policy, or applicable law — without refund.
As a condition of entry, you consent to a search of your person and belongings. Prohibited items may be confiscated at entry and will not be returned. The Festival may expand the list of prohibited items at any time without notice.
Unlawful or unauthorized resale (or attempted resale) of a ticket is grounds for forfeiture of the ticket and revocation of entry without compensation.
The Festival is not responsible for tickets that are lost, stolen, counterfeit, or purchased from unauthorized sellers, and such tickets may be refused.
Unauthorized recording, transmission, or commercial broadcast of any performance is prohibited.
You agree to comply with all posted rules, all applicable laws, and the reasonable directions of Festival staff and security at all times.
To the fullest extent permitted by law, the Festival's total liability to you for any claim shall not exceed the face value of the ticket(s) you purchased.
These terms are governed by the laws of the State of Florida. Any dispute shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.
If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in full force and effect.
The Festival may update these terms at any time; the version posted at the time of your purchase or attendance applies.
